The Americans with Disabilities Act celebrated its 26th anniversary in July 2016.  Never, in the history of the Act, has litigation been higher and they just raised the cost of non-compliance again.  More importantly, the Federal Agencies have recommitted to the enforcement of the ADA and are doing so by withholding Federal Funding.

Unfortunately, compliance has never been more confusing. Change often causes confusion and the standards and their application have changed, as of March 15, 2012.Are you ready? Do you have an up-to-date transition plan if the Department of Justice were to ask for it? Did you know you needed one? Do you know what needs to be in it or how to put it all together? Do you realize not having one can jeopardize any federal funding you receive and put you at risk of litigation? Not just from the DOJ but also from private citizens. Compliance with the Americans with Disabilities Act is mandatory. That fact seems to becoming clearer and clearer as cities around the country, have been hit with both private law suits from local citizens and large settlement agreements from the United States Department of Justice.
